Two way relationship between staff and bosses

BLM partner Frank Hughes provides our latest legal update for The Scotsman. This month, Frank looks at the issue of vicarious liability in the workplace.

"When an employer hires a member of staff, they make a promise to look after them in the workplace by paying them a fair wage and watching over their health and safety. But those promises cut both ways. With those employment rights also come responsibilities.

"Employees are often their employer’s most visible representatives, the public-facing first point of contact in a company. If an employee’s conduct in the workplace falls short of the standard expected, the employer can be left carrying the can. Welcome to the world of 'vicarious liability'."
