Simple Procedure in Scotland is replacing small claim and summary case procedure for non-personal injury actions of less than £5,000 raised on or after today (Monday 28 November).
The new Simple Procedure is also expected to be extended to personal injury claims of less that £5,000 during the second half of 2017. It is intended to be proactive for the court and front-loaded with the respondent, stating at the earliest stage whether liability is admitted or disputed.
