BLM partner and head of occupational disease, Nick Pargeter, has expressed his concerns about misplaced expectation levels of general damages in mesothelioma claims, following the publication of the Judicial College Guidelines for the Assessment of General Damages in Personal Injury Cases in a letter to the editor of Solicitors Journal.
“Mesothelioma claims are not currently subject to part 2 of the 2012 Act. General damages in these claims should not therefore attract the 10 per cent increase. It may be an oversight that two columns of figures are nonetheless provided for these claims, at chapter 6(C)(a) of the new edition for mesothelioma.”
