EL/PL portal analysis report

The casualty practice group has carried out a detailed analysis on the recent statistics for employers’ liability (EL) and public liability (PL) claims for the period 1 August to 31 October 2019 (August to October - Q2).

This analysis identifies the following key points:-

  • A decrease by 8.8% in the number of CNFs sent/received for EL claims when comparing the average for August to October 2019 with the average for the corresponding period in 2018. In comparison, there was also a decrease by 7.52% in the number of CNFs sent/received for PL claims when comparing the average for August to October 2019 with the average for the corresponding period in 2018.
  • A slight decline in the number of EL and PL claims that exit the portal at stage 1. However, it remains the case that the majority of claims (over 50% of claims) exit at stage 1. 
  • A continuing decline in the number of stage 2 exits each year. This is evidenced by a percentage decline by 5.92% in the number of EL claims that exited at stage 2 during August to October 2019 when compared with the same period in 2018. In comparison, the number of PL claims which exited the portal at stage 2 during August to October 2019 increased by 0.65% when compared to the same period in 2018. However, overall the number of PL claims exiting at stage 2 has gradually declined.
  • The number of stage 2 settlements for EL claims increased by 2.94% when compared with the same period in 2018. In comparison, the number of stage 2 settlements for PL claims decreased by 1.66% when comparing August to October 2019 with the same period in 2018.
  • An increase by 11.50% in the number of EL and PL court packs created when comparing averages for August to October 2019 with the corresponding period for 2018. It is predicted that there will be a similar increase in the number of court proceedings packs created in 2020 if there continues to be less settlements at stage 2 and fewer claims exiting the portal.
  • A decrease in the number of unresolved claims in 2019 compared to the figures for 2018. This is positive because there had been a significant rise in the number of unresolved claims in 2017 and 2018 when compared to previous years. However, there needs to continue to be a significant decline in unresolved claim numbers in 2020 in order to reach pre-2017 figures.
  • An increase in average general damages offered for EL and PL claims by approximately 1.50% when comparing August to October 2019 with the corresponding period for 2018.
