The occupational disease arena has witnessed a spike in the number of industrial deafness claims being brought since the implementation of the Civil Justice Reforms. As these claims represent around 75% of all disease claims in the market, the impact of this trend on defendants will be significant. Other disease claims, such as asbestos-related conditions, work related stress and musculo-skeletal cases remain fairly constant in volume yet require specialist technical handling to manage the causation and insurance scenarios involved and achieve the right outcomes. In addition, deliberate exaggeration or organised fraudulent activity is another emerging risk that demands concerted action.
